These Terms of Use govern your access to and use of the ShiftIntoGear website and services. By using the site you agree to these terms. If you do not agree, do not use the site.
1. What ShiftIntoGear is
ShiftIntoGear is an online advertising platform that lets private sellers, motor dealers and vehicle owners advertise cars for sale and for rent, and lets buyers and renters make contact and enquiries. We are not a motor dealer, we are not a party to any sale, rental, finance or insurance agreement, and we do not inspect, own or take custody of any vehicle. Any contract is formed directly between the users involved.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to create an account. You are responsible for keeping your login details secure and for all activity under your account. Provide accurate information and keep it up to date.
3. Listings and user content
If you post a listing or other content, you confirm that it is accurate, that you are legally entitled to sell or rent the vehicle, and that your content does not breach any law or third party rights. Listings are reviewed before they appear, but review does not mean we endorse, verify or guarantee any listing. We may edit, refuse or remove any content at our discretion. You keep ownership of your content but grant us a licence to display it on the site.
4. Buying, selling and renting
We do not guarantee the accuracy of any listing, the condition, history, roadworthiness or ownership of any vehicle, or that a seller or renter will complete a transaction. You are responsible for your own due diligence, including inspecting the vehicle, confirming ownership and finance owing, arranging any independent inspection, and complying with registration, roadworthy and transfer requirements in your state or territory. Nothing on this site excludes rights you have under the Australian Consumer Law that cannot be excluded.
5. Finance information
Any finance figures, repayment calculators and buying power tools are general information and estimates only. They are not an offer of credit, not credit assistance and not financial, credit or tax advice, and they do not take account of your objectives or situation. We are not a credit provider or credit assistance provider. Actual rates, fees and approval depend on the lender and your circumstances. Consider your own situation and seek advice from a licensed credit provider before entering any credit contract.
6. Valuations and estimates
Vehicle valuations and price estimates are automated guides based on limited information. They are not a guaranteed offer or an appraisal and actual value may differ significantly. Do not rely on them as the sole basis for any decision.
7. Rentals and cover
Rental arrangements are made directly between the renter and the vehicle owner. Any insurance, protection or cover described in a listing is offered by the owner or a third party, not by ShiftIntoGear, and is subject to that provider's own terms, limits and eligibility. Confirm what cover applies before you book.
8. Prohibited use
You must not post false, misleading or unlawful content, list a vehicle you are not entitled to sell or rent, harvest other users' data, attempt to gain unauthorised access to the site, or use the site to defraud or harass anyone.
9. Disclaimer and liability
The site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties not expressly set out here and are not liable for any loss or damage arising from your use of the site, any dealing with another user, or reliance on any listing, valuation or finance figure. Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to resupplying the relevant service or paying the cost of resupply. Nothing in these terms limits rights that cannot be limited by law.
10. Changes and termination
We may change these terms, or suspend or withdraw the site, at any time. Continued use after a change means you accept the updated terms. We may suspend or close accounts that breach these terms.
11. Governing law
These terms are governed by the laws of Australia and the state or territory in which we operate, and you submit to the courts of that jurisdiction.
